Terms of Service for VibeGate

Please read these Terms and Conditions (“Terms,” “Terms of Service”) carefully before downloading, accessing, or using the VibeGate mobile application (“App,” “Service”) operated by Idea Strider DBA (“we,” “us,” or “our”).

By downloading, installing, or using VibeGate, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

1. Description of Service

VibeGate is a digital wellbeing and mindful intention application designed to help users build healthier smartphone habits. The App allows users to designate specific distracting applications (“Shielded Apps”) and prompts the user with mindful breathing exercises and personal intentions before accessing those apps.

2. Eligibility & Account Status

  • You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use VibeGate.
  • VibeGate does not require account registration or passwords. You are responsible for maintaining the physical security of your device and managing your in-app configurations.

3. Subscriptions, Free Trials, and Billing

Certain features of VibeGate require an active subscription (“VibeGate Pro”). All payments and subscriptions are processed exclusively through Google Play Billing.

A. Free Trial

  • VibeGate may offer a free trial period (e.g., 7 days) for new subscribers.
  • Auto-Conversion: Unless you cancel at least twenty-four (24) hours before the end of the free trial period, your trial will automatically convert into a paid, recurring subscription at the price indicated at the time of purchase.
  • You can cancel your trial at any time in your Google Play Store account settings without being charged.

B. Recurring Subscriptions & Renewal

  • Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renew is disabled at least 24 hours prior to the current cycle ending.
  • Your Google Play account will be charged for renewal within 24 hours prior to the end of the current subscription period.

C. Cancellation & Management

  • You can manage or cancel your subscription at any time by navigating to:
    Google Play Store > Profile Icon > Payments & subscriptions > Subscriptions > VibeGate.
  • Alternatively, you can tap “Manage on Google Play” inside the Settings tab of the VibeGate App.
  • Cancelling a subscription stops future billing; you will continue to have access to Pro features until the end of your current paid billing period.

D. Refunds

  • Refund requests are governed by Google Play’s standard refund policies. We do not have direct access to your payment methods or billing information.
  • To request a refund, please follow Google Play’s official refund procedure at Google Play Refund Support.

4. Android Permissions & Accessibility Service Authorization

To provide its core application-interception and mindful gating functionality, VibeGate requires access to Android’s AccessibilityService API.

  • User Acknowledgment: By enabling the VibeGate Accessibility Service in your device settings, you explicitly grant VibeGate permission to detect when selected applications are brought to the foreground.
  • Privacy Limitation: The AccessibilityService is strictly used for app detection and will never be used to monitor, read, capture, or store screen text, keystrokes, personal messages, or private data.
  • Revocation: You may revoke this permission at any time via your device’s Settings > Accessibility > VibeGate. Note that revoking this permission will prevent the App from displaying focus gates on shielded apps.

5. Wellness & Mindfulness Disclaimer

  • VibeGate is designed solely as a personal productivity, mindfulness, and habit-formation tool.
  • Not Medical Advice: VibeGate does not provide medical, psychological, psychiatric, or healthcare advice, diagnosis, or treatment. It should not be used as a substitute for professional mental health counseling or medical guidance.

6. Intellectual Property

The App, its original content, design, user interface, graphics, algorithms, and trademarks are the exclusive property of Idea Strider and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

7. Prohibited Uses

You agree not to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works based on the App.
  • Use the App in any manner that violates local, state, national, or international laws.
  • Circumvent or disable any technological protection measures or subscription verification gates in the App.

8. Disclaimer of Warranties

VibeGate is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, bug-free, or entirely error-free on all Android device models and operating system versions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Idea Strider, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of time, loss of profits, or device malfunction arising out of or related to your use of or inability to use the App.

10. Termination

We reserve the right to suspend or terminate access to our Service without prior notice or liability for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of your jurisdiction of operation (or the State/Country of registration of Idea Strider), without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When changes are made, we will update the “Last Updated” date at the top of this document. Continued use of the App following any revisions constitutes your acceptance of the new Terms.
